Best option when your business domain name is taken?

Someone has already registered a domain under my business name, but they haven't setup a site. They have domain privacy so I can't contact them to offer to buy the .com

Should I just buy a .biz and go from there? Really want the .com but don't want to get held up on such a minor issue. Need to get things rolling
