Odds of success or failure aside, if a person wants to start their own Uber or Lyft copycat, is there a legal reason they couldn't do so?

I was having a conversation with a friend the other day who mentioned that, if some random joe wants to create an Uber/Lyft copycat, they might be unable to due to patents, etc. Is this, in fact, the case? (I'm not concerned with whether this individual would succeed or not; I'm merely curious as to whether they could be a legitimate entrée into the market without being shut down and/or having their pants sued off.)
